US Amateur Band Plan - Terms of Service

Welcome to US Amateur Band Plan. By accessing or using our app, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use US Amateur Band Plan and uninstall the app.

1. Acceptance of Terms

By downloading, installing, or using US Amateur Band Plan, you confirm that you:

  • Are at least 13 years old (or meet the minimum age required in your country).
  • Agree to follow these Terms and our Privacy Policy.
  • Accept that violating these terms may result in suspension or termination of your access to the app, or any other action pursuant to law.

This agreement is solely between you and BioRust Studios, LLC ("BioRust Studios," "we," "us," or "our"). Apple Inc. ("Apple") is not a party to this agreement and bears no responsibility for the app or its content.

2. License

Subject to your compliance with these Terms, BioRust Studios grants you a limited, non-exclusive, non-transferable license to use US Amateur Band Plan on any Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service. This license does not allow you to use US Amateur Band Plan on any device that you do not own or control.

3. General Use

  • Informational Purposes Only: US Amateur Band Plan is intended as a quick reference tool for amateur radio band allocations. It is not a substitute for official regulatory publications or legal advice.
  • Lawful Use: You agree to use the app only for lawful purposes and in compliance with all applicable laws and regulations, including FCC rules and regulations governing amateur radio.
  • No Misuse: You agree not to misuse, reverse engineer, or attempt to exploit the app in any way.

4. Purchases & Billing

  • In-App Purchases: Some features may require purchase. All pricing is displayed within the app prior to purchase.
  • Platform Billing: All purchases are processed through the platform you downloaded the app from — Google Play or the Apple App Store. By making a purchase, you also agree to that platform's terms of service and billing policies.
  • Google Play: Purchases made on Android are subject to the Google Play Terms of Service. You may request a refund through Google Play within the timeframe permitted by Google's refund policy.
  • Apple App Store: Purchases made on iOS are subject to the Apple Media Services Terms and Conditions. Refunds for App Store purchases are handled by Apple and may be requested at reportaproblem.apple.com. In the event of any failure of US Amateur Band Plan to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to US Amateur Band Plan.
  • Refund Requests (Google Play): If you purchased through Google Play, you may also request a refund directly from BioRust Studios by emailing contact@bioruststudios.com. Refund requests are evaluated on a case-by-case basis and are not guaranteed outside of what is required by applicable law or platform policy. Apple App Store purchases can only be refunded through Apple.
  • Modifications: We may update pricing, features, or plans with prior notice.

5. Maintenance and Support

BioRust Studios is solely responsible for providing maintenance and support services for US Amateur Band Plan, as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to US Amateur Band Plan. For support, contact us at contact@bioruststudios.com.

6. Content and Usage

  • Accuracy: While we strive to keep band plan information accurate and up to date, we make no guarantees regarding the completeness or accuracy of the information provided. Always verify with official sources before operating.
  • Use at Your Own Risk: US Amateur Band Plan is for reference and informational purposes. You are solely responsible for ensuring your amateur radio operations comply with applicable regulations.
  • No Guarantee: We do not guarantee the accuracy, completeness, or suitability of the information provided for any particular purpose.

7. Limitation of Liability

Service Availability: We do not guarantee uninterrupted or error-free access to US Amateur Band Plan. US Amateur Band Plan and its service is provided "as is" and "as available," without warranty of any kind. Without limiting this, we expressly disclaim all warranties, whether express, implied or statutory, regarding the app and the service including without limitation any warranty of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement.

8. Product Liability

BioRust Studios, LLC, not Apple, is responsible for addressing any claims by you or any third party relating to US Amateur Band Plan or your possession and/or use of US Amateur Band Plan, including but not limited to: (i) product liability claims; (ii) any claim that US Amateur Band Plan fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

9. Intellectual Property

In the event of any third-party claim that US Amateur Band Plan or your possession and use of US Amateur Band Plan infringes that third party's intellectual property rights, BioRust Studios, LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

10. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable third-party terms of service when using US Amateur Band Plan (e.g., your wireless data service agreement).

11. Termination & Account Suspension

We reserve the right to suspend or terminate your access if:

  • You violate these Terms.
  • You engage in harmful, illegal, or disruptive behavior.
  • The app or its service is discontinued for any reason.
  • For any reason.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of US Amateur Band Plan after updates means you accept the new Terms.

13. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
